Current status. The tool is a free preview at the moment; there is no payment, no contract and no delivery. Once a paid offering is added, general terms and conditions, a right-of-withdrawal notice and details of the payment provider will apply. This page will be extended then.
1. What the tool does
You answer a few questions. From those answers the tool calculates a design proposal: colours, typefaces, measurements and a geometric mark. The calculation runs entirely in your browser; your input is not transmitted (see the privacy policy, available in German).
2. The trademark research is not a clearance
The tool does not check whether a mark may be used, and it cannot do so. It prepares searches in public registers and names the figurative classification of the generated mark. Nothing beyond that.
Whether a mark is free depends on registered trademarks in several registers, on unregistered use, on company and work titles, on name rights, and on the similarity of the goods and services involved. Ultimately it is a legal assessment of likelihood of confusion, not a database query.
A hit does not necessarily mean an obstacle. No hit does not mean the mark is free. Before filing a trademark application or making a larger investment in the brand — signage, packaging, print, vehicle livery — a search belongs in the hands of a lawyer specialising in intellectual property. That recommendation is meant seriously, not as boilerplate.
3. Marks can resemble one another
The marks come out of a finite system of shape families, colours and typefaces. That has a consequence you should know about before you decide:
- Two brands with the same initial letter, the same shape family and a similar colour will receive very similar or practically identical marks.
- Basic geometric forms — circle, diamond, angle, dot grid — are widespread and, on their own, have little distinctive character. For marks like these, legal protection regularly arises only in combination with the name.
- The tool keeps no register of marks already issued and therefore cannot guarantee you any exclusivity.
Anyone who needs a distinctive, protectable mark needs handwork. This tool delivers a sound, coherent design — not a point of difference.
4. Rights in the result
I make no claim to any rights in the design proposal generated for you. You may use it without restriction, unlimited in time and territory, for your own purposes — commercially or privately, modified or unmodified, including for a trademark application of your own.
Two limits, which come not from me but from the nature of the thing:
- I cannot transfer rights I do not hold. Whether the result infringes third-party rights has not been examined (see section 2).
- The bundled typefaces carry their own licence. These are exclusively typefaces under the SIL Open Font License 1.1; the licence text is included with every package. It permits commercial use, redistribution, embedding, and converting letters into paths. It requires that the licence text accompany the font files if you pass them on, and that modified versions not use the original name.
5. No advice
The tool does not provide legal, tax or business advice. The notes on colour perception and industry norms are based on published market research (Labrecque & Milne, 2012 and 2013) and are general orientation, not a promise about effect, revenue or success.
6. Availability and liability
The offering is a free preview. There is no entitlement to continuous availability. I am liable under the statutory provisions for intent and gross negligence, and for injury to life, body or health. In cases of ordinary negligence I am liable only for breach of a material contractual obligation, and limited to the foreseeable damage typical of such contracts. Any further liability is excluded.
7. Governing law
The law of the Federal Republic of Germany applies. Mandatory consumer protection provisions of the state in which you have your habitual residence remain unaffected.
